1. Service Description

Arex Ltd provides premium lead generation, market intelligence, and business growth tools ("the Service") to registered business clients in Kenya. The Service includes access to our proprietary dashboard, AI-driven insights, and a network of active sales agents.

2. Subscription Plans & Payments

Access to premium features requires a valid subscription (Gold, Platinum, or Diamond). Payments are processed via M-Pesa or Bank Transfer. Subscriptions are billed on a recurring basis (Monthly, Quarterly, or Yearly) unless cancelled. All fees are stated in Kenyan Shillings (KES).

3. Lead Quality & Delivery

Arex guarantees the delivery of "Verified Leads" as per your subscription tier. We employ rigorous vetting processes; however, lead conversion depends on your business's sales efficacy. We do not guarantee a specific conversion rate.

4. Cancellation & Refunds

You may cancel your subscription at any time via the dashboard. Cancellations take effect at the end of the current billing cycle. Refunds are not provided for partial months or unused services, except where required by Kenyan law.

5. Business Conduct

You agree to treat all leads and data provided by Arex with professional integrity. Misuse of lead data, spamming, or violation of consumer protection laws will result in immediate account termination.

6. Limitation of Liability

Arex Ltd shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, including but not limited to loss of profits or business interruption.

1. Information We Collect

We collect information about your business (Company Name, Registration Details), your usage of our dashboard, and transaction data. We also process data regarding the leads we provide to you.

2. Use of Business Data

Your business data is used to:

• Provide and personalize your dashboard experience.
• Generate AI-driven market insights and recommendations.
• Process payments and manage your subscription.
• Match your business with the most relevant leads and agents.

3. Lead Data Handling (Compliance)

You act as a "Data Controller" for the personal data of leads you receive. You agree to comply with the Kenya Data Protection Act, 2019. You must not use lead data for any purpose other than the direct solicitation of your business's products or services.

4. Data Security

Arex utilizes "Secure Cloud Infrastructure" to protect your business intelligence and customer data. We implement strict access controls and encryption standards.

5. Third-Party Sharing

We do not sell your business strategy or proprietary data to competitors. We may share data with service providers (e.g., payment processors like Safaricom/M-Pesa) strictly for service delivery.

Welcome to Arex Ltd. By accessing our platform and participating in our Premium Referral Marketing program, you agree to comply with these Terms of Service. Arex Ltd is a registered entity in Kenya, committed to providing high-quality digital marketing solutions.

2. Eligibility

To participate in our referral program, you must be at least 18 years of age and a resident of Kenya with a valid M-Pesa registered phone number. By registering, you confirm that all information provided is accurate and verifiable.

3. Referral Program Mechanics

Agents earn commissions by referring valid leads that result in closed deals. "Valid leads" are defined as genuine interest from potential clients who meet our qualification criteria. Fraudulent leads or self-referrals will result in immediate account suspension.

4. Payments & Commissions

All commissions are paid via M-Pesa. Payments are processed according to your selected payout schedule (Weekly, Bi-Weekly, or Monthly). The minimum withdrawal amount is KES 100. Arex Ltd reserves the right to withhold payment pending investigation of suspicious activity.

5. User Conduct

You agree to promote Arex products ethically. Spamming, misleading claims, or misrepresentation of Arex products is strictly prohibited. You are an independent contractor, not an employee of Arex Ltd.

6. Termination

We reserve the right to terminate your account at any time for violation of these terms. Upon termination, any forfeited earnings will not be paid out.

7. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.

We collect personal information necessary for your participation in our program, including your Name, Email Address, and M-Pesa Phone Number. We may also collect data on your device and usage patterns to improve our platform.

2. Use of Information

Your data is used to:

• Process referral commissions and M-Pesa payouts.
• Verify your identity and prevent fraud.
• Communicate with you regarding your account and performance.
• Improve our marketing strategies and platform functionality.

3. Data Sharing & Third Parties

We do NOT sell your personal data. We only share data with trusted third parties necessary for our operations, such as Safaricom (for M-Pesa transactions). We may disclose data if required by Kenyan law or legal process.

4. Data Security

We employ industry-standard encryption and security measures to protect your data. However, no method of transmission over the internet is 100% secure.

5. Your Rights (Kenya Data Protection Act)
